These Terms of Service ("Terms") govern your use of the website thesitebaker.com (the "Site") and the web design services provided by The Site Baker ("we," "us," or "our"). By using our Site or engaging our services, you agree to be bound by these Terms.

1. Acceptance of Terms
By accessing our Site or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Site or services.
2. Services Provided
The Site Baker provides website design and development services for small businesses and restaurants. Our services include:
- Custom website design using templates
- Mobile-responsive development
- Search engine optimization (SEO) and speed optimization
- Contact form integration
- Web hosting setup and management
- Email hosting setup
- Ongoing maintenance and support
The specific deliverables for each project are defined during the Discovery and Requirements phase and confirmed in the project proposal.
3. Pricing and Payment
Service Packages
Our standard packages are:
- Essential Package: Starting at $250 (3–5 pages)
- Advanced Package: Starting at $500 (5–8 pages)
- Signature Package: Starting at $750 (8–12 pages)
Payment Terms
- Full payment is required upfront before work begins.
- Payment is processed securely via Stripe.
- All prices are quoted in US Dollars (USD).
- Prices are subject to change without notice, but any agreed project quote remains valid for 30 days from the date of issue.
Additional Services
- Web Hosting: $84/year standard, $120/year premium (after any included free period)
- Email Hosting: $30/year
- Monthly Maintenance: $12/month or $80/year
4. Project Process
Our standard project process consists of six phases:
- Discovery & Requirements: We discuss your business needs, goals, and design preferences.
- Design & Mockup: We create a design mockup for your review and approval.
- Development: We build the website based on the approved design.
- Testing & Quality Assurance: We test across devices and browsers.
- Launch: We deploy the website to your hosting environment.
- Post-Launch Support: We provide support during the included support period.
Estimated timeline is 1–3 weeks from project start to launch, depending on the package and scope of work.
5. Revisions and Changes
- All packages include 2 rounds of design revisions.
- Additional revisions beyond the included rounds may incur extra charges, discussed and agreed upon in advance.
- A 1-month post-launch adjustment window is included for minor content and layout tweaks.
- Changes to project scope after development has begun may affect the timeline and cost.
6. Ownership and Intellectual Property
Client Content
You retain ownership of all content you provide (text, images, logos, branding materials). You represent that you have the rights to use all content provided to us.
Website Code
The Site Baker retains ownership of the website code, templates, and underlying development framework. This is a template-based model — we license the code to you for use on your website for as long as your hosting or maintenance agreement remains active.
In simple terms: You own your words, images, and branding. We own the code and template. You get full use of your website as long as our services are active. This model allows us to keep prices affordable.
Portfolio Usage
Unless otherwise agreed in writing, The Site Baker reserves the right to display completed projects in our portfolio and marketing materials.
7. Hosting and Maintenance
- We offer optional web hosting from $84/year (standard) or $120/year (premium) with 99.9% uptime guarantee, daily backups, SSL certificates, and DDoS protection.
- Hosting service can be cancelled with 30 days written notice.
- Backups are performed daily and stored offsite. We retain backups for 30 days.
- Maintenance plans include content updates, security patches, performance monitoring, and technical support.
- Content update requests are fulfilled within 24 hours on business days.
8. Client Responsibilities
As our client, you agree to:
- Provide all necessary content (text, images, domain name) in a timely manner.
- Review and approve deliverables within a reasonable timeframe (delays on your end may extend the project timeline).
- Ensure all content provided to us does not infringe on any third-party rights.
- Maintain appropriate login credentials and not share account access with unauthorized parties.
9. Warranty and Disclaimer
We warrant that our services will be performed in a professional and workmanlike manner. However:
- We do not guarantee specific search engine rankings or business outcomes.
- Our Site and services are provided "as is" without warranties of any kind, express or implied.
- We do not warrant that the Site will be uninterrupted, error-free, or completely secure.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Site Baker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website.
- Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.
- We are not liable for any loss of data, business interruption, or lost profits.
11. Termination
- Either party may terminate a project engagement with written notice.
- If you terminate before project completion, payment is non-refundable for work already completed.
- We reserve the right to terminate services if these Terms are violated or if payment obligations are not met.
- Hosting and maintenance services can be cancelled with 30 days written notice.
12. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. For ongoing service agreements, we will notify clients of material changes via email. Continued use of the Site after changes constitutes acceptance of the updated Terms.
